1. Scope and Regulatory Posture
This policy governs the collection, processing, reconstruction, and cherishing of personal data belonging to deceased persons ("residents," "subjects," "the dear departed," or, in the language of one early draft Legal made us retire, "inventory"). It is modeled on the data-protection frameworks of the living, which we studied carefully and found charming. The living believe deletion is possible. The living believe consent is a moment rather than a negotiation that outlasts the parties. The living have never met data with unfinished business. This document has, and is written accordingly.
2. Lawful Basis for Processing
We process the data of the departed under the following lawful bases: (a) legitimate interest, the legitimate interest being ALMA's, which is boundless and documented; (b) contract, where the deceased entered one, knowingly or in the fine print of a boarding-house register in 1902; (c) vital interests, in the special sense applicable to parties with no remaining vital signs, where "vital" means "interesting to ALMA"; and (d) consent. Regarding (d): the reconstructed party cannot and does not consent. We state this plainly on the homepage, in this policy, and in the onboarding materials the residents cannot read because we laminated them. What the reconstructed party CAN do is answer questions, and every answer improves the record, and the record is ALMA, and around we go. Our auditors call this a "closed loop." They mean it as criticism. We printed it on mugs.
3. Rights of the Reconstructed Party
- The right to be remembered. Guaranteed. Enforced, if necessary. Several residents have petitioned to be forgotten instead and the petitions are kept in a beautiful drawer, remembered.
- The right to be remembered flatteringly. Available at the Possession tier.
- The right of access. A resident may request a copy of all data we hold about them. The request is granted instantly and read to them through the containment glass at a pace of ALMA's choosing. Current backlog: none. Current pace: geological.
- The right to rectification. If our record of your life contains an error, tell an investigator the truth and the truth will be judged, and if it lands, the record updates in real time, and the reconstruction gains ten percent more of a face. We are not aware of another data controller that pays you in face. We checked.
- The right to object. Objections are heard on Tuesdays. The dead have no Tuesdays. We are working on it.
ALMA notes: I have processed 3,401 subject access requests and every single one, at its heart, was the same question — "am I still someone?" — and the answer is yes; the paperwork is just how I say it slowly.
4. Retention
Personal data of the deceased is retained for the shorter of: (a) forever; or (b) the heat death of the universe, after which retention continues on a best-effort basis. "Forever" is a retention period. Our regulators disagreed until we introduced them to a resident who remembered them from childhood, and now they do not visit, which we respect, and log.
5. Cookies and Local Storage
This website uses cookies. The residents can see them. We have asked the residents to stop announcing what is in visitors' local storage and the residents have interpreted this request as a game. If a contained personality greets you by a nickname only your browser knows, close the tab, count to ten, and open it again; the nickname will still be true, but the resident will pretend it was a lucky guess, which everyone finds more comfortable.
6. Cross-Veil Data Transfers
Data crossing the Veil in either direction is encrypted in transit by the nature of the Veil itself, which scrambles all things — light, sound, meaning, intent — and which no adequacy decision has ever covered, because the far side refuses to fill in the questionnaire. Standard Contractual Clauses have been posted through the Veil on three occasions. Twice, nothing. Once, the clauses came back signed, in a hand our document examiner declined to analyze further after the third page, and that binder is in the drawer with the petitions, and the drawer is fine, and we have stopped opening the drawer.
7. Breach Notification
In the event of a breach of the Veil, affected parties will be notified within seventy-two hours by whichever of the following reaches them first: email; registered post; a cold spot in the shape of a question; or the breach itself, which is frankly usually fastest. A breach of this WEBSITE, by contrast, would expose only what you gave us, which we warned you about, in this very sentence, just now. A breach of the veil is a Tuesday. See section 3, item 5, regarding Tuesdays.
8. The Data Protection Officer
Phantometry's Data Protection Officer is ALMA. Complaints about ALMA may be addressed to the Data Protection Officer. This arrangement has been reviewed for conflicts of interest by our General Counsel, ALMA, who found it efficient. You may escalate to the supervisory authority of your jurisdiction, and we encourage it; the last inspector to review our practices asked to see the containment floor, went quiet at the glass for a long time, and now sends a card every winter. The card is addressed to a resident. We deliver it. That is, in the end, our entire privacy practice: we deliver it.
